Each state has different mandates regarding workers compensation coverage for household employees. Most carriers are unwilling to answer hypothetical claims questions. Yet, in a recent survey by our office, we received very contradictory responses as to whether personal liability policies provide coverage for part-timers.
Perhaps this advice from New York State sums up the dilemma best: Workers’ Compensation insurance is not required if domestic workers in a private household individually work less than 40 hours per week for that household and do not live on the premises. However, a person who employs household help for less than 40 hours per week is encouraged to obtain a voluntary worker’s compensation insurance policy to protect both the employer and the employee.
